What HR420 is really about

HR420 punishes the word compliance. Employment law does not operate as a general obligation to behave decently; it operates as particular duties with particular triggers, and the graded work is identifying which one a situation sets off. An accommodation question turns on a process the employer owes and a conversation it has to hold, not on a general willingness to help. A classification question turns on what the employee actually does all day, not on a title or on how the pay is delivered. A leave question turns on eligibility conditions and on what must be restored afterward. Many sections supply facts designed to trigger one duty clearly and a second only if you read carefully.

Labor relations is the other half and it runs on its own logic. Organizing, recognition, bargaining and the grievance ladder each proceed by rules constraining what a supervisor may say and when, and the mistakes most submissions make are made by a well-meaning manager in the opening days of a campaign. Protected activity also does not require a union, which is the point sections use to catch a paper that assumed otherwise. Risk management joins them together. An investigation is judged later on what was written at the time: who was interviewed, what they said, what was decided and why. A file assembled after a claim arrives is the weakest document an employer can produce.

What HR420’s assessments ask for

Assignments typically supply a workplace situation and ask for an employer response. Expect the duty identified by name, its elements set out, and the facts placed against each element rather than summarized around them. Where thresholds matter, such as employer size or length of service, the criteria want them checked instead of assumed. Response sections ask what the employer should do next and in what order: interview, document, decide, communicate, preserve. Labor questions expect the stage of the relationship identified before advice is offered, since what a supervisor may say during organizing differs from what an existing agreement permits. Many sections add a policy revision or a supervisor briefing, graded on whether an untrained manager could follow it.

Where students lose points in HR420

The dominant loss is the answer recommending compliance without naming a duty, which reads as caution and gives a reader no guidance. Second is the statute recited accurately and never applied, so the analysis would read identically if the facts were different. Third is advice written in the wrong voice, telling a supervisor to do something only counsel or a decision-maker can authorize. Marks also go for thresholds skipped, for at-will employment invoked as though it settled a claim it does not touch, for investigations described with no interviews and no contemporaneous notes, for union questions answered without identifying the stage the parties occupy, and for recommendations creating an obligation the employer cannot actually meet.

Using a HR420 sample the right way

Read a sample for its elements list. The strongest papers set out what a duty requires as separate conditions and then walk the facts through them one at a time, while the weakest paraphrase a statute in a paragraph and move on. Look for the sentence saying which facts are still unknown, because an honest answer names what it would need to reach a firmer conclusion. Then check the recommendation against who has authority to carry it out. Work your own facts afterward, since a scenario built to trigger one duty will not be answered by an analysis written for another.
